This Privacy Policy explains how information about you is collected, used and disclosed by Rainbow Massage,and its subsidiaries and affiliated companies (collectively, “ETM”, “we” or “us”). This Privacy Policy applies to information we collect when you use our websites or when you otherwise interact with us electronically (the “Services”). Please note that your visits to our website are subject to this Privacy Policy.

We may change this Privacy Policy from time to time at our sole discretion. If we make changes, we will notify you by revising the date at the top of the policy and, in some cases, we may provide you with additional notice (such as adding a statement to our homepage or sending you an email notification). We encourage you to review the Privacy Policy whenever you access the Services to stay informed about our information practices and the ways you can help protect your privacy.

Franchise Owners

ETM is the owner of and operates the Elements Massage® franchise system in which Elements Massage franchise studios (“Studios”) are each independently owned and operated by Elements Massage franchise owners (“Franchise Owners”). ETM does not have any agency, partnership, employment, or joint venture relationship with any Franchise Owners. Franchise Owners may use third-party social media plug-ins, applications, and other content on portions of the Services for their respective Studios (“Franchise Owner Content”) which may obtain and use your information and may have different privacy policies governing the use of your information. By accessing or using Studios’ specific portions of the Services, you acknowledge that ETM does not control or bear any responsibility for the privacy policies, terms of use, security & data protection measures, or other policies of Franchise Owners or any third parties associated with Studios’ specific portions of the Services.

Information We Collect

We collect: 1) information you provide to us, 2) information which is automatically collected by using the Services, and 3) information from other sources.

  • Information You Provide to Us. We collect information you provide directly to us, such as your name, e-mail address, and contact information.

  • Information Automatically Collected by Using Services. We log information about your use of the Services, including the type of browser you use, access times, pages viewed, your IP address, general location information (e.g., city, county, and/or state), and the page you visited before navigating to our Services. We may also collect information about the computer or mobile device you use to access our Services, including the hardware model, operating system and version, unique device identifiers and mobile network information. We also use various tracking technologies; for more information, please see the “Cookies & Tracking Technologies” section of this Privacy Policy.

  • Information We Collect from Other Sources. We may obtain information provided by other companies and organizations, such as our marketing and promotional partners. We may additionally collect information you submit to a social media site (such as your name, photo, gender, birthday, location, interests, account information and friends lists) in accordance with the authorization procedures determined by such social media site and its privacy policies governing the use of your information. We may also receive information from Franchise Owners.

How We Use Your Information

We may use information about you for various purposes, including to:

  • Provide, maintain and improve our Services and the Elements Massage® franchise system;

  • Provide and deliver the products and services you request, process transactions and send you related information, including confirmations and invoices;

  • Send you technical notices, updates, security alerts and support and administrative messages;

  • Respond to your comments, questions and requests and provide customer service;

  • Communicate with you about products, services, offers, promotions, rewards, and events offered by ETM and its affiliates, and provide news and information we think will be of interest to you;

  • Monitor and analyze trends, usage and activities in connection with our Services;

  • Personalize and improve the Services and provide advertisements, content or features that match user profiles or interests;

  • Process and deliver contest, sweepstakes, and other promotional entries and rewards;

  • Link or combine with information we get from others to help understand your needs and provide you with better service; and

  • Carry out any other purpose for which the information was collected.

ETM is based in the United States and the information we collect is governed by U.S. law. By accessing or using the Services or otherwise providing information to us, you consent to the processing and transfer of information in and to the U.S. and other countries.

ETM does not intend to market any products or services to, or conduct any profiling or targeting activities regarding, natural persons in the European Union.

How We Share Your Information

We may share information about you as follows or as otherwise described in this Privacy Policy:

  • With Franchise Owners, our shareholders, creditors, investors, board of directors, employees, agents and representatives working on our behalf;

  • With vendors, consultants and other service providers who need access to such information to carry out work on our behalf, including but not limited to credit card processing and order fulfillment if you choose to purchase products or services through the Services;

  • With our affiliates, marketing partners, or other direct marketers, so they can send you notices about their products or services.

  • In response to a request for information if we believe disclosure is in accordance with any applicable law, regulation or legal process, or as otherwise required by any applicable law, rule or regulation;

  • If we believe your actions are inconsistent with the spirit or language of our user agreements or policies, or to protect the rights, property and safety of ETM or others;

  • In connection with, or during negotiations of, any merger, sale of company assets, financing or acquisition of all or a portion of our business to another company; and

  • With your consent or at your direction, including but not limited to if we notify you through our Services that the information you provide will be shared in a particular manner and you provide such information.

We may also share aggregated or de-identified information, which cannot reasonably be used to identify you.

Cookies & Tracking Technologies

We and our third-party service providers use cookies and other tracking mechanisms to track information about your use of our website or Services. We may combine this information with other personal information we collect from you (and our third party service providers may do so on our behalf).

Cookies are alphanumeric identifiers that we transfer to your computer’s hard drive through your web browser for record-keeping purposes. Some cookies allow us to make it easier for you to navigate our website and Services, while others are used to enable a faster log-in process or to allow us to track your activities at our website and Services. There are two types of cookies: session and persistent cookies.

We may also collect information using web beacons (also known as "tracking pixels"). Web beacons are electronic images or other computer codes that may be used in our Services or emails and help deliver cookies, count visits, understand usage and the effectiveness of our communications and determine whether an email has been opened and acted upon.

ETM additionally uses, or may use in the future, the following technologies: Java scripts, which are codes that are embedded within the Services to provide usage statistics and other monitoring information; entity tags which cache certain information within your browser; and HTML5 local storage features which can help the Services load faster from cached data within your browser.

Third-Party Ad Networks & Opting-Out

Our website uses third party cookies and other technologies from Google Analytics. You can opt-out of Google Analytics’ display advertising services by using the Ad Settings Feature available here, which lets you control which information Google uses to show you ads. Further, a Google Analytics Opt-Out Browser Add-on is available to disable Google Analytics tracking.

Users in the United States may further opt out of additional third-party ad networks. The Digital Advertising Alliance (“DAA”) Consumer Choice Page features information about opting out of interest-based advertising and their choices regarding having information used by DAA companies. The Network Advertising Initiative (“NAI”) Consumer Opt-Out Page features information about opting out of interest-based advertising and their choices regarding having information used by NAI members.

Opting out from one or more companies listed on the DAA Consumer Choice Page or the NAI Consumer Opt-Out Page will opt you out from those companies’ delivery of interest-based content or ads to you, but it does not mean you will no longer receive any advertising through our website or on other websites. You may continue to receive advertisements, for example, based on the particular website that you are viewing (i.e., contextually based ads). Also, if your browsers are configured to reject cookies when you opt out on the DAA or NAI websites, your opt out may not be effective. You may opt out of receiving promotional emails from ETM by following the instructions in those emails. If you opt out, we may still send you non-promotional communications, such as those about your account or our ongoing business relations. Franchise Owners may conduct their own promotional email communications; please consult their communications’ terms for information on opting out.

Do Not Track Notice

ETM does not support “Do Not Track” browser settings. Consult the “Third-Party Ad Networks & Opting-Out” section of this Privacy Policy for information about opting-out of certain targeting advertising services.

Mobile Terms & Conditions

  1. You must be at least thirteen (13) years of age or older to sign up for or otherwise participate in any mobile text programs offered by ETM. Please see the “Use by Children” section of this Privacy Policy for more information.

  2. There is no fee to receive messages from us; however, your carrier’s message and data rates may apply. Check with your mobile service provider. Charges are billed and payable to your mobile service provider or deducted from your prepaid account. Consent to receive text messages from us is not required or a condition of purchasing any goods or services at Elements Massage studios.

  3. By providing your mobile number, you consent to receive up to 2 automated text messages to complete your sign-up. You will receive recurring messages. You can unsubscribe from these reminders at any time by texting “STOP” to 201201 (a confirmation message will be sent).

  5.   8. ETM reserves the right to remove mobile text program subscribers from its messaging database at its sole discretion. Further, these mobile terms and conditions are subject to change at any time without notice.

Security

ETM takes reasonable measures to help protect information about you from loss, theft, misuse and unauthorized access, disclosure, alteration and destruction. Because no data transmission over the Internet is completely secure, and no system of physical or electronic security is impenetrable, we cannot guarantee the security of the information you send to us or the security of our servers or databases. We further do not control any third parties’ websites or other security measures.

By using the Services, you agree to assume all risk in connection with the information sent to us or collected by us when you use the Services.

Use by Children

We do not intend for our websites or Services to be used by anyone under the age of 13. If you are a parent or guardian and believe we may have collected information about your child, please contact us as described in the "Contact Us" section of this Privacy Policy.
